1. Introduction

Welcome to Family Sweets Valenzuela, an online cake ordering platform that offers real-time 3D personalization. Please read these Terms & Conditions carefully before using our website or services. By placing an order for Products through this website, you understand, agree with, and accept:

  • these Terms and Conditions and any corresponding changes thereto which we may implement from time to time; and
  • our Privacy Policy concerning how we process your personal information collected from this App.

For purposes of these Terms and Conditions, Family Sweets Valenzuela”, "our" or "we" shall refer to Family Sweets Valenzuela., while "customer" or "you" shall refer to the customer who intends to purchase the Products from this website.

2. Eligibility

To use the Platform, you must be at least 18 years old or have permission from a parent or legal guardian. By placing an order, you confirm that you are legally capable of entering into binding contracts.

3. Account Registration

  • Account Creation: To place an order, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
  • Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

4. Ordering Process

  • Custom Cake Orders: Our Platform allows you to customize cakes in real-time using our 3D design tool. Please review your customization carefully before placing an order.
  • Order Confirmation: Once your order is placed, you will receive an order confirmation via email. This confirmation does not guarantee acceptance of your order, which may be subject to availability, payment verification, and other factors.
  • Changes and Cancellations: Once an order is confirmed, changes or cancellations may not be possible, depending on the stage of production. Please contact us immediately if you need to make adjustments.

5. Pricing and Payment

  • Pricing: Prices listed on the Platform are in Philippine Pesos (PHP) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time without prior notice.
  • Payment Methods: We accept payments through digital wallets. After placing your order, you will be provided with a QR code to scan and complete the payment.

  • Delivery Time: We strive to deliver within the specified time frame but cannot guarantee exact delivery times due to factors beyond our control.
  • Delivery Fees: Delivery fees will be determined after your order is placed, based on your location. The exact fee will be communicated to you separately and is to be paid in addition to the order amount.

7. Product Quality and Warranty

  • Product Representation: We strive to accurately represent our products through our 3D customization tool. However, the final product may vary slightly in appearance due to the nature of food products.
  • Product Warranty: We guarantee that our cakes will be fresh and made to your specifications. If you are not satisfied with the quality, please contact us within 24 hours of receiving your order.

8. Returns and Refunds

  • Non-Returnable Items: Due to the perishable nature of our products, all sales are final, and returns are not accepted.
  • Refunds: Refunds will only be issued if the product received does not match your order specifications. Please note that Family Sweets Valenzuela is not liable for any damages that occur during delivery, as the delivery process is managed by third-party couriers. Refund requests must be submitted within 24 hours of receiving the product.

9. Intellectual Property

All content on the Platform, including images, designs, text, and software, is the property of Family Sweets Valenzuela and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Family Sweets Valenzuela shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or the products purchased through it.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Valenzuela City, Philippines.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform constitutes acceptance of the revised Terms.
